Thai Living WillIn Thailand, the right to refuse medical treatment is in provision under Thai law. The Ministerial Regulation prescribing the procedures for living wills took effect on 2007, endowing a person with the right to make a living will. The National Health Commission Office of Thailand have guidelines on which types of treatments may be refused in a living will, which includes resuscitation and mechanical ventilation, nutritional and hydration assistance, including dialysis. For pregnant patients, her wishes will be observed after the birth of her child.

Prior to performing a Thailand living will, doctors should know the patient’s intentions; such a way that the patient may confirm the intent or if not possible, by a witness or any relative of the patient. It is recommended that the patient make known his or her living will to relatives and loved ones. Patients now have the right to have their living will enforced, and to refuse health services which would prolong their terminal stage in life. Thai law now awards patients the freedom to choose and the freedom to deny medical treatment during their most critical moments in life.

Restrictions of a Thai Living Will:

  • A living will should never be confused with a last will and testament – which gives provisions on how properties and assets are distributed after death. A Thai living will has nothing to do with your properties.
  • A living will does not permit Euthanasia, or mercy killing. Medical professionals are not authorized to cause the death of their patients through performing affirmative acts such as lethal injection.
  • A living will does not include any medical or healthcare power of attorney, by which any individual may appoint an agency or substitute to make decisions regarding the patient’s healthcare and medical treatment in critical circumstances. The living will is a legal document which a person may inform medical care providers, family members and loved ones his or her medical wishes in the event that he or she is not capable of communicating such wishes due to critical illness.
