This is the No Fault Divorce. The divorce by mutual consent is a type of divorce in Thailand which does not require grounds for divorce. This type of divorce takes place before the Amphur in Thailand at the local district office, and requires agreement between both parties to divorce as well as an agreement on the division of all marital and jointly owned properties, child custody and spousal alimony. If the married couple does not come up with an agreeable solution, and could not settle in any case. Then, each party can file a petition based on the grounds provided by the Civil and Commercial Code of Thailand for the termination of the marriage thru court intervention, wherein the Thai Family court would get to decide for them regarding matters in accordance with Thai law. However, if a prenuptial agreement exists, the court will assess the validity and the enforceability of the contract.

Under the CCCT, it is stated that any clause included in the prenuptial agreement which is contrary to public morals, and that any relations between them regarding these properties to be governed by foreign laws shall be made void.

When both parties come to an agreement regarding the terms of the divorce, the procedure is much simpler, less expensive and takes lesser time to process. Divorce by mutual consent does not require direct Thailand divorce lawyer representation, and both parties should agree on all possible issues and potential conflicts as with the division of properties, spousal maintenance, child support and custody.

Also, it is not required that the divorcing couple file a divorce at the same location where they registered the marriage, but both of them should be personally present when filing a divorce by mutual consent in front of the Amphur.

The divorce by judgement of Thai court, or contested divorce, takes more time and money, requiring both parties to show up constantly in court and be represented by a Thailand divorce lawyer. Always speak to a lawyer about a no fault divorce in Thailand.
